Analyses And Thoughts On The Submitting To Administrative Verdicts And Patching Up Suits

Administrative adjudication is one of the ways to resolve the dispute, but also asa means of state-controlled society, it is an effective mechanism for maintaining socialorder. Though guaranteed by the coercive force of the state, that the process of theadministrative judgment can be accepted and the verdicts can be obeyed sincerely bythe parties are more conducive to administrative disputes’ resolution and fulfilling itsfunctions of safeguarding the social stability. Submitting to verdicts and patching upsuits refers to a state in which the parties submit themselves to a court decision andend the suit. Submitting to verdicts is the reason of the patching up suits and patchingup suits the result.The key problem this paper deals with aims at seeing through present conditionof which and making preliminary analysis about the reasons behind the condition,meanwhile, proposing some solutions of enhancing the acceptability of administrativeverdicts. In short, this paper is trying to prove a basic fact, that it is significant toimprove the acceptability of administrative verdicts for the public.The first part is the introduction of submitting to verdicts and patching up suitsand the reason of this paper’s writing.The second part is the positive analysis of the administrative verdict from1990to2011in the view of disputing parties and in the view of court, through the rate ofsubmitting to first instance judgment, the rate of second-instance judgment, ofappealing to executing the order, of vote of second-instance judgment, of the vote ofreview, and of maintaining the verdicts coming into effect.The third part is the qualitative analysis of the submitting to verdicts andpatching up suits of administrative verdict from1990to2011. The conclusion is thatparties’ acceptability of administrative verdicts is enhancing constantly, but the rate ofsubmitting to first instance judgment needs to get more attention.The fourth part is for the analysis of reasons influencing the submitting toverdicts and patching up suits of administrative verdicts.The fifth part is for some solutions of enhancing submitting to verdicts andpatching up suits of administrative verdicts.
