| In recent years, with the development of economic, the application of the liedetector get more and more extensive. The application of the polygraph test expandedfrom the criminal investigations to civil proceedings. However, there are no related lawslegislated regarding the application of polygraph conclusion, which always led to thedisorder and dispute in civil proceedings. Should polygraph be used in civil proceedingsand it qualified to be used as evidence? And what kind of problem will be appeared if itused in civil proceedings? The paper mainly discussed these problems from the civillitigation and evidence lean angle.The thesis is divided into three chapters to research the application of polygraphconclusion. The first chapter desirables briefly the concept, the origin and thedevelopment of polygraph technology, summarizes the procedure of how to get thepolygraph conclusion and the influence factors. The second chapter is to proof therationality of polygraph conclusion ‘s application in civil proceedings, which from byintroducing foreign related laws and regulations to analyzing special cases used inChinese civil proceedings, and discussing several oppositions mainly. This chapter alsorefers to the problems appeared in the application of polygraph conclusion. Based onthe analysis of the first two chapters, the third part mainly puts forward improvementmeasures, including the measures of perfecting the civil system and learning some basicevidence rule from abroad, which also is the innovation of this paper. |
