On Legislative Protection Of Personal Information Under The Network Environment In China

Modern society is rapidly to the information society evolution, bears the interests of the personality of natural person increasingly highlight the economic value of personal information, personal information, as a kind of very important economic resources, can provide the basis for government decision-making, can also be for commercial use. Due to the lack of effective legal norms to enforce the protection of personal information, personal information by alteration, abuse phenomenon often happens, has seriously affected the peaceful life of the individual, the developed network information can be made easier by the effective dissemination and sharing, it is convenient and people’s lives at the same time, personal information is also suffering a worse safety test. At present, the phenomenon of serious infringement of personal information, the protection of personal information is lack of basic legal basis, to protect personal information rights consciousness is weak, and a series of present situation, the urgent need to build personal information legal protection system in our country.In this paper, the text has four parts. The first part, first of all to define the concept of personal information, then on the concept and characteristics of network information is summarized in general. Describes the network of personal information protection theory foundation, the introduction of personal information under the network environment protection application, and dedicated to the protection of personal information in network transactions. The second part, analysis the status of the legal protection of personal information under the network environment and existing prominent problems, especially the legislative lag, lack of legal protection directly. The third part, to Germany, the United States, Japan and Hong Kong and Taiwan in our country the legislation mode of a comparative study, it puts forward the model of the unity of the personal information protection legislation in our country. The fourth part, looking to the legal protection of personal information, clarify the obligations and responsibilities of Internet service providers, and to make recommendations to improve the protection of personal information under the network environment in China.
