The Green patent fast examination program is to shorten the duration of the green patent examination, so the applicant will be able to obtain the right as soon as possible. Green patent fast examination program is conducive to promoting innovation and deployment of green technology. The program not only brings alternative ways to the applicant, but also has great significance for the protection of the environment and ecology. Currently, UK, Australia, South Korea, Japan, the United States, Israel, Canada, Brazil, China, Latvia have implemented its green patent fast examination program, while the subject eligibility, examination procedures, and the implementation effects of each program is different. China has released "Administrative Measures for the Priority Examination of Invention Patent Applications", involving patent applications such as energy conservation and environmental protection, new energy, new materials, low-carbon technology, conservation of resources and so on. However, there are some defects on the subject matter and examination procedures of the "Measures"; which is not only targeted for green patent. This paper attempts to put forward several suggestions for improvement of China’s green patent fast examination program by analyzing and summarizing the practice and experience of some developed countries’programs.This paper is divided into three parts:the introduction, the body and the conclusion. The introduction presents the research background and significance as well as the history and current situation of the study.The dissertation contains four chapters. Chapter One is a comprehensive introduction to the green patent and its fast examination program, giving a systematical analysis of green patent system, the identifi cation and fast examination green patent, summarizing the system characteristics and its contributions and limitations. Chapter Two mainly introduces the Green Channel Program in the UK, Super-accelerated Examinations for Green Technology in the South Korea, the Accelerated Examination System in Japan and the Green Technology Pilot Program in the U.S. respectively, based on which analyzes and summarizes the foreign green patent fast examination system. Chapter Three is an evaluation of the "Administrative Measures for the Priority Examination of Invention Patent Applications" issued by the State Intellectual Property Office of China. Chapter Four puts forward some recommendations on the optimization and improvement of China’s green patent fast examination system based on the above chapters.The conclusion refines the full text, and summarizes the main points of this paper.
