Nowadays, climate change and energy crisis are the two big challenges which we are facing in the world. As the key to solving these problems,green energy technologies and industry has been widespread concerned in various countries and organizations. Especially after 2009, as the World Intellectual Property Day, "Green Innovation" is the theme that was affirmed by World Intellectual Property Organization. Currently, the Intellectual Property Office of the United States, Japan, Britain and other major developed countries, has developed the green technologies system.Although China has made some achievements in the green energy industry, but because the core technology is relatively backward, so the patent system has just a few achievements. Research on the patent system is an effective way to change this situation.This paper consists of an introduction, body and conclusion. Then introduction presents the research background and the significance of this paper briefly reviewed, refined research status and theoretical results on the issue of domestic and foreign.The dissertation is divided into four chapters. Chapter one presents an overview of green energy technologies, the research status also describes various types of green energy technologies. Chapter two describes the difficulty of green energy technologies in the course of the development and the need to establish encountered green energy patent system. The patent fast examination system and green patent compulsory licensing in the patent law is the good way to promote innovation and to develop clean energy technologies. Chapter three introduces the developed countries including the United States, Japan, Britain and other major developed countries, using the new patent system to protect green energy technologies, which including patent examination, compulsory licensing and soon. Chapter four describes the problems in China's green energy technology, the relevant system of green energy technologies to analyze patent protection, which summarizes the deficiencies and makes recommendations for the improvement of the green patent licensing, patent examination.The conclusion of this paper refines and summarizes the core ideas in the text.
