During the late1990s, the concept of "timeshare" was introduced to China. Taking China’s national conditions into accound, the Property Hotel with Chinese characteristics was first born in Hainan province, and then developing throughout the whole country. According to incomplete statistics, the number of China’s Property Hotel has grown to more than300, and there are many Property Hotel projects are being constructed all over the country. After years of development, the Property Hotel has integrated a variety of superior resources and becomes a fashion of investment that including real estate, tourism and hotel industry. However, the Property Hotel in China is still in the early stage of development, the uncertainty of related laws and regulations makes the development of the Property Hotel difficult. Also the negative reports and legal cases related to Property Hotel was increasing. This is not only harm the interests and rights of investors, and also not conducive to the stable development of the economy. Therefore, the research on the legal issues of Property Hotel is important. And putting forward the proposals to build a sound legal system of Property Hotel, so as to promote the legislation of Property Hotel and strengthen the legal regulation of it is urgent.This paper discussed the comprehensive analysis on Property Hotel, according to our country’s practice, based on the overseas related legislation experience, puts forward some legal suggestions for development of Property Hotel, in order to promote the healthy development of Property Hotel.This paper is divided into four parts:The first part,interpretation of Property Hotel.Defined in comparison with other similar concepts through the hotel property rights, a clear concept and content of the Property Hotel and elaborated further on the nature of the hotel property rights and legal characteristics.The second part, On the the Property Hotel legislative necessity and feasibility analysis. First of all, by the operation of the hotel property rights in China, legal risk, credit risk, market risk analysis, the necessity of the Property Hotel healthy development of the need for legislation. Second, the combination of the best use of the characteristics of Property Hotel to explore and analyze the feasibility of Property Hotel legislation.In the third part, through studying on the similar legal regulation on Property Hotel in other countries, like the United Kingdom, the United States and Malaysia, summarizing the legislative experience of the three countries and introducing the advanced ideas and inspiration they have, so as to build our legal system on Property Hotel.The fourth part,put forward relevant legal suggestions on Property Hotel development. Property Hotel. First proposed a the principle recommendations specification property hotel; Secondly, it is proposed to establish specific legal advice mainly to protect the interests of investors, Include:clear the management department, clear the land for construction of residential properties,introduce third-party guarantees, establish information disclosure system, introduce the cooling-off period, and establish exit mechanism.
