This article begins with the relationship between the carbon emissions limits and the establishment of a new international economic order, then make studies on competition of carbon emissions between developing countries and between developing countries and developed countries, for further discussing China’s development situation, and analysis the corresponding legal system. At the same time, make a detailed comparison of legislation and practice between Europe and America and other developed countries to put forward our country’s suggestions in the carbon emissions legislation as well as in the establishment of the international economic order. The article discussed from different attitudes to treat "Kyoto Protocol" between the developed countries and developing ones, from the national carbon emissions benefit game in this paper, through Europe and the United States legislation comparison, and then puts forward the corresponding measures should be taken by our country.The article roughly from six parts, makes studies of the relationship between the national emissions game and the establishment of new international economic order process, to further discuss the impact on the countries of the world:The first part, making comprehensive overview of the international carbon emission reduction, through the analysis of the attitude change before and after signing "Kyoto Protocol", and the different positions to face the "Kyoto Protocol" between China and America.The second part, from the Chinese perspectives on international carbon emission reduction, which means in the maintenance of Chinese develop right to discuss the strategies and methods of carbon emission reduction, and put forward our suggestions and comments.The third part, by making the international comparison of carbon trading market legal rules between the Europe and America summed up the experience for reference to improve China’s relevant laws and regulations.The last part, by learning the Cancun Conference on carbon emission reduction recommendations for future international climate change legislation occurred in positive affect, put forward strategy and measure of our country.
