Risk Prevention Of Trademark Licensing

The trademark license is an extension of the exclusive right of trademark, trademark licensed to use effectively the functional value of the trademark. Trademark licensing system to the benefit of both sides of leave at the same time, of course, can not ignore the risks. The rise time of the trademark licensing system in China is still relatively late, and related systems are still inadequate in some respects even still blank, The licensor and the licensee do not fully aware of the trademark licensing risks, there lack of adequate dispute settlement mechanism, leading to there are many problems in practice by the stage of China’s trademark licensing system. In this thesis, the analysis of Wang Lao Ji trademark dispute, combined with the problems in the practice, theory and practical point of view put forward some countermeasures better to prevent trademark licensing risks, improve our trademark licensing system.This thesis analyzed those issue on the risk of trademark license system, try to explore the risk prevention of the trademark license system and give some suggestions revising the Trademark Law.Apart from introduction and conclusion, this thesis includes three chapters.Chapter One, the development of trademark license, The pros and cons of trademark licensing and classification, legal characteristics, conditions, and trademark licensing.Chapter Two, combine the Wang Lao Ji trademark dispute, the analysis of the risks of the trademark licensing system in practice, mainly from three aspects:risk analysis before the trademark licensing, trademark licensing contract risk analysis and trademark licensing after risk analysis.Chapter Three, by the status quo of China’s judicial and Countermeasures against risks in the use of the trademark license, from the perspective of law changes, the improvement of the system, the operator strategies.
