Research On Environmental Risk And Risk Prevention And Control Of Oil And Gas Enterprises

As an important strategic resource,oil and gas have been paid much attention by all countries in the world.In recent years,the demand for oil and gas is increasing due to the rapid development of China's economy.Annual production of the domestic oil and gas by the enterprises are rising,oil and gas imports is also drastically increased over the years.As the pillar enterprise of energy supply,the importance of oil and gas enterprises is self-explanatory.However,from the historical perspective,oil and gas companies are environmental infringement risk enterprises and its production will cause serious negative effects to the ecological environment.Environmental damage not only endanger the survival and development of human beings,it is also bound to restrict the sustainable development of oil and gas enterprises.The current situation of environmental issues in our country is very serious.People are complaining and ask to severely crack down on bad environmental behavior and put more efforts to fight against environment violation so as to improve the environmental quality in the country.In April 24,2014,China had revised the 1989"environmental protection law".The revised "environmental protection law" has many highlights,with breakthroughs and innovation in many aspects.The penalties are significantly increased.It is known as "the history of the most stringent" environmental protection law.It can be predicted that with the implementation of the new law,our country's ecological environment will be protected.It has given the prevention and control of environmental pollution a shot in the arm."Green" has become the hot word of the 4"13th Five-Year" at the beginning of the year NPC and CPPCC.It also become the "13th Five-Year" development of the tone.A new green principle is also added in the new general civil law passed in March 15,2017.Thus,the concept of green environmental protection has been gradually formed in the minds of people in our country.A consensus on the green development concept has been reached in our country.Under this background,oil and gas companies,which are the high risk violations of the environment enterprise,will face the environmental infringement legal risk if they do not implement the scientific and effective risk prevention and control.This will bring immeasurable losses to the oil and gas companies,thereafter cause great pressure on the sustainable development of enterprises.Therefore,with the implementation of the new environmental law,oil and gas enterprises in our country are facing a difficult situation.From the urgency in development sustainability point of view,the risk of violation of the law and the corresponding risk control measures will be studied.This paper is divided into five parts.The first part summarizes the background,the significance of the topic,research status and research methods.In the second part,the environment and environmental issues,environmental tort and environmental tort legal risks of oil and gas enterprises and a series of related concepts are combed and defined.The third sections summarizes the common exposure to environmental pollution in the process of production and management by the oil and gas companies,through case analysis pointed out that the environmental damage impact on enterprise,environment and society.The fourth part embarks from the new "environmental protection law".The legal risks,from the focus on new situation,the oil and gas enterprises would face,discussed the present in environmental infringement risk prevention and control aspects of the current problems and difficulties in oil and gas enterprises.The fifth part put forward the significance of prevention and control of environmental infringement legal risks of oil and gas enterprises,to explore the basic principles of the construction of oil and gas enterprises of environmental infringement legal risk prevention and control,improvement and recommendation on the legal risk prevention and control of oil and gas companies to improve the environment,put forward some suggestions,including participation in environmental liability insurance,establish diversified risk transfer channels,improve the environmental management system and emergency plans,the establishment of enterprise information disclosure system of environmental infringement.The full text is gradually deepening from theory to practice,whose aim is to put forward some references and recommendations about environmental and risk management of Chinese oil and gas companies,contribute my strength for laying a good battle of blue sky and building"beautiful Chinese".
