In the view of the theory of natural law, natural law is above positive law and positive law slaves and reflects natural law. If positive law doesn’t reflect the requirements of the natural law, the positive law must be draconian laws. Draconian laws have no real legal effectiveness, the subject of draconian laws have the right to resist. From the point of view of the theory of natural law, the concept of equality has important significance to the development of international economic law. The concept of equality embodied in each stage in the process of the development of international economic law, international economic law may deviate from the concept of equality, but in the end it will reflect the requirements of the concept of equality. For the changing international community, international economic law in order to play its role to solve the new problems and new challenges which emerge from the international economic law effectively, practicing the concept of equality is the most reliable guarantee. During dealing with the international social and economic activities, regarding the concept of equality as guidelines and theoretical foundation, the international economic law will move in the right direction.The paper is divided into five parts. The first part introduces the study’s purpose, significance, research status at home and abroad, the paper structure, research methods and the innovations of the paper.The second part focuses on the development context of the theory of natural law, introducing different stages of natural law and the theoretical framework of natural law.The third part discusses the relationship between international economic law and the basic concept of international economic law in the framework of natural law theory. Emphasizing the importance of the basic concept of international economic law and setting the concept of equality as the most important basic concept of international economic law.The fourth part focuses on how the concept of equality reflected in every stage of the development of international economic law. Each stage of the concept of equality is different. What the countries pursue is the real concept of equality. The international economic law will be promoted as far as it is under the basic of the concept of equality.The fifth part emphasizes the guidance of the concept of equality in the new challenges in the context of globalization in the contemporary international economic law, carbon tariffs as well as north-south issue and the significance of the concept of equality for the future development of the international economic law.
