The Study On Chinese Public Officials Property Declaration System

The property declaration system of Public officials is favorable for corruptionprevention, establishing the system of property declaration law is called "sunshineact", the establishment of "sunshine law" in all countries of the world, which is basedon the purpose of preventing illegal rich or preventing conflicts of interest, it followsthat the anti-corruption value of this system is approved by countries all over theworld.In recent years, China’s anti-corruption work is fruitful; the specific performanceis that we have dealt with a large number of corruptions. With the advancement ofdemocratic rule of law in our country, the anti-corruption work can be sustained andin-depth; in order to make the anti-corruption work institutionalization, normalization,the demand to establish the property declaration system and guide the work of theanti-corruption campaign operation by the system is increasing. Although rules ofproperty declaration system are established in our country, the rules are not mature;there are numerous problems that need to solve. And writing of this paper was basedon this purpose.By defining the conception of public servant property declaration system, andelaborating the development our country public officials property declaration systemin standard and practice level, the content of our present property declaration systemis summarized as follows: the main body of declaration, the object of declaration, themethod of declaration, institutions of accepting and examining the declaration, theaudit supervision of the declaration content and responsibility of declaration, andbased on those aspects generalizing the characteristics of public servant propertydeclaration system in China. By analyzing the theoretical basis of public officials’property declaration system, the author tries to provide reasonable basis for theestablishment and improvement to the public servant property declaration systems inthe form of law of China. Furthermore it lays the basis for later problems andsuggestions Through reflections on the content of public officials property declarationsystem in China, combining the reality of our country at present, I think the objectand ways of declaration regulation is to be able to meet the needs of the presentanti-corruption. The problem is mainly in the aspect of system basis to thespecification of the declaration, the main body of declaration, institutions of acceptingand examining the declaration, the after supervision of declaration and responsibilityset, which is need to be perfected. Aiming at the problem of public servant propertydeclaration system in our country, on the basis of using the experience of foreigncountries, the author will list the perfect opinions one by one. According to theproblems of specification, by developing the property declaration law, it can provideauthoritative basis for the perfection of the system; In view of the problems of themain body, the subject will be defined for all civil servants, to regulate the behaviorof the civil servants group; For the problem of insufficient technicality of thesupervision institutions, confirm the basis to acceptance and supervision ofdeclaration as the discipline inspection organs and procuratorial organs, to guaranteeauthority agencies can perform their duties independently; For the supervise of afterdeclaration, through the interpretation of the government information disclosureregulations, to establish the principle of open that supervision should follow, dodifferent public method for different content of declaration; For the aspects of theresponsibility system, set up diversified liability, make different punishment aimingat different plots, so as to ensure the coercive power supplies for property declarationsystem.A variety of research methods are used in this paper, such as empirical analysis,value analysis, comparative analysis method. Besides the author attempts to apply themethod of hermeneutics, which involves the interpretation of meaning, purpose,system interpretation.Although the methods may be used immature, it is a kind ofbeneficial attempt. What’s more, the use of hermeneutic method is the innovation ofthis article.By the briefly explanation to related content of the law of the People’s Republicof China government information disclosure regulations, it is concluded that we shallmake public information on public officials property declaration, which can be as a solution suggestion to the current ineffective supervision after public officialsproperty declaration in China.
