The Study Of Public Officers’ Property Declaration

The system of publishing the property of national officials is a legal systemwhich forces a certain range of national public publicans to report and publish theproperty of themselves and their main family members, aiming building up an honestgovernment by performing the public’s right of knowing as well as the right ofmonitoring. According to the foreign experience, the system of publishing theproperty of national public officials has become an indispensable legal system toprevent and control the problem of corruption.Foreign systems of publishing the national officials’ property originated from18th century and were widely established in the1970s and1980s,while in our countrythe exploration of publishing the property of the public officials was not started until1980s. Although relevant files as well as regulations was made during the past30years and the publishing of local officials’ property was conducted in some places,due to the exist of missing of terms in the system as well as lack national mandatoryconstrains, the effect of anti-corruption was not obvious. To establish a perfect systemto publish the public officials’’ property, from the aspect of the government it isnecessary to build a monitor network inside each public sectors to cooperate withintegrals in order to monitor the officials’ foreign property. While the monitor insidethe government was carried on, it is also required to establish an external monitorsystem to encourage the public to monitor the situation of publishing the property ofpublic officials. In this article I will discuss these issues in details.This paper consists of three parts. The argument structure of each part is asfollows: The first chapter is the establishment of the public system of the property for the national public officials. It discusses the necessity by comparing the developmentof the public system of property for the public officials abroad. After elaborating thepublic system of property abroad, it analyzes the lack of the property declarationsystem and the debate about public system of property in China. The second chapterdemonstrates the significance of establishing the scope of the obligation of publicservants, and discusses the scope of the properties, which needs to publicize. Thethird chapter is the procedure of the property publicity, which covers declaration,acceptance, and examination, open, oversight and accountability mechanisms of thepublic system of property.
