Study On Legal Supports Of Transnational Seed Company’s Strategy

With the development of knowledge economy and economic globalization, Intellectual Property is increasingly becoming an important resource and the core competitiveness of seed industry development, becoming the key to grasp the initiative and the important supporting of the development of modern seed industry. A certain sense, agricultural intellectual property has become the focus of enterprise competition and national industry construction, it is imminent of Intellectual Property strategy for domestic seed companies. Thus it is important to study on Intellectual Property strategy and sum up the successful experience of domestic seed companies, so as to provide a reference for the implementation of intellectual property strategy for domestic seed companies.This study integrated use of literature, comparative analysis and other analysis methods, starting from the present situation of intellectual property rights of the multinational seed companies for multinational enterprise’s patent, varieties, trademark for quantitative analysis. First of all, to summarize characteristics of multinational seed enterprises intellectual property rights; Secondly, based on the number of patent applications, the annual change and technology applications such as content analysis, understand the technology research and development direction of international seed enterprises and the development trend of the market. Then review the status of applications for new varieties of plants multinational seed companies, and for quantitative analysis of its application in China’s case. Finally, analyze the trademark application conditions and the application characteristics of the multinational operation of seeds.Multinational seed companies intellectual property strategy is a unified whole. In the creation of intellectual property, the companies through increased research investment, the introduction and training of qualified personnel, to create the world’s biological resources library and other means to enhance their research capabilities.
