China officially joined the WTO in2001,from this moment our country officially openthe market to meet challenges from the world. Opening education service trade market as aWTO member is part of its commitment. As a less-developed country of educationservices,China is facing huge challenges. These challenges involves with China’s educationalsovereignty, inheritance of national culture, education system reform and other major issues.Considering issues above and the reality of domestic situation, from the view of protectingexisting educational services market, China’s attitude has to be very cautious as many othercountries in opening educational market and preserve it to an large extent.Thus only improvethe competitiveness of our education service trade, that transform our country from a bigeducation country into a powerful one, from an educational importing country to an exportingone, given the fierce competition in the international market. so as to play the biggestopportunity after China’s entry into the WTO. As education services related laws andregulations system is the most important line of defense education services market, thisarticle aims to combine Chinese laws and regulations, China ’s WTO commitments andconcessions signed a series of agreements with domestic existing educational services tradelegal framework to improve our education services trading system. This article will discussthis in the following sequence:The first part is introduction, which illustrates the meaning and purpose of this thesis,literature reviews on education service market problems, methodology and creativity.The second part discussed basic concepts and characteristics of the education servicetrade form three aspects.trade. First is the connotation and characteristics of the internationaltrade in services. Second is the international education service trade connotation andcharacteristics. Third is the summary of the international education service trade laws.The third part said the "GATS" scope of international trade in education services,international trade in education services provide ways, International Trade in EducationServices Principles and Exceptions.Which specifically stated the China’s WTO reductioncommitments; enumerating the performance of four different methods in education service trade, which are cited cross-border supply, consumption abroad, commercial presence,natural Immigrant; discussing six principles of international trade in education services andexceptions to these principles.The fourth part mainly discusses the legislative situation of China’s education servicetrade and existing problem. first it introduces China’s current situation of International trade inservices involved in the legislative situation. Second it introduces the domestic problems ofinternational education service trade legislation, involves the conflict between China’sdomestic law and international law and the loopholes in legislation iThe fifth part is the suggestions to the international service trade legislation of China.First, clear the international education service trade legislation principles, namely theprinciple of national sovereignty, the principles of international cooperation, the principle ofrespect for international treaties, as well as the principle of gradually opening educationmarket. Secondly, Construction and improvements of foreign-related education servicestrade legal systems are discussed in detail.In conclusion, Chinese scholars in the field of international education service trade therelatively late start, low level,the research method is relatively backward. Although recentyears, there is a lot of literature and the emergence of research results, of which are mostlyfrom a macroeconomic perspective on foreign trade in education services, not to focus on thelegal issues of international trade in education services research.It makes the concerningforeign education service trade legislation relatively lags behind, which urgeslegislation.Given this, this thesis discusses the development trend of international trade ineducation services, basic principles and exceptions, trade situation and the status of relevantlegislation for comprehensive evaluation and analysis problems. It provides solutions toforeign trade in education services imperfect legislation, gaps and more fragmentation andother issues. It would be great if this personal work contributes to perfection.
