| As a new member of WTO, Chinese Law Service market is opening to all the members of WTO. The trade barriers of law service trade are existing because of the natural deficiency of GATS etc. While for the Chinese law service, the protect of barriers won't last forever. It have to improve it's competitive power. This paper is divided in five parts.In part one, After the definition of law service, this part expounds the Character of high expertise, region and wide popularity of law service.The second part introduce the rules of the law service trade. The author defines clearly the law service trade and then introduce the rules in five parts.The third part compare Chinese law service promises with part of foreign countries'. On the basis of the statement of law service promises made by China and internation, the article analyzes Chinese law service promise.The fourth part analyzes the barriers of law service trade. In the field of law service in China, there are some restrains on the foreign lawyer's business scope, the establishment of foreign lawyer's office and the foreign lawyer's identificafion level and resident time. In the writer's view, the reason of the above trade barriers mainly exists in the following aspects.First is the natural deficiency of GATS, Then, it is the inevitable result of the accentuation the state sovereignty. Then, it is because of the low development level of law service and weak competition in international market. Finally, it dues to the speciality of law.At the end of this article, the writer probes how to open the law service market and how to perfect law system, analyzes the legislation of market body, malket behavior vegulation and the market management regulation. At the same time, the article gives us some advices on strengthening the ability of international competition. These advices are the of the occupation of lauyer, the industrialization of law service, and specialization of law service, the strengthening of supervision of law service business. |
