Research On The International Regulation System Of Educational Service Trade

Before the advent of GATS,trade in education services already existed,but it was not recognized by most countries in the world.After GATS,trade in education services was regulated under the multilateral trade legal system,and education service trade as a service trade was better Wide recognition.The appearance of GATS has extremely important significance for the development of education service trade,reducing the barriers to education services trade and promoting the liberalization of education service trade.However,as a special service trade,education service trade also faces more development.problem.Only less than one-half of the WTO members have made commitments to education services.The further negotiation of the WTO has made little progress.The multilateral service trade rules have been developing slowly.More and more countries are turning to cooperation under the free trade agreement and they are free.Breakthroughs have been made under the trade agreement.This thesis is mainly from the perspective of the WTO's multilateral trade rules and bilateral trade rules under the free trade agreement.It studies the current status of the international legal system of education service trade,and integrates with China's existing education service trade legal system,and its legal system.This thesis is mainly divided into five parts,the main content is as follows:The first part is the introduction,which mainly describes the background and significance of the research on the international legal system of education service trade,the research status of domestic and foreign scholars,briefly introduces the research content of the thesisi,the research method and the innovation of the research.The second part mainly focuses on the related legal concepts of education service trade.Education service trade is different from cross-border education.Cross-border education includes education service trade.The education services trade can be classified according to the provisions of GATS,and these are important foundations for the regulation of educational services by multilateral and bilateral agreements.The origin of the international law of trade in education services can be divided into legal documents regulated by global international organizations and regional international conventions and bilateral international agreements.The former are mainly GATS regulations and the latter include the North American Free Trade Agreement.And China-Korea Free Trade Agreement and so on.The third part focuses on the GATS regulation of education service trade.The specific commitment schedule on market access and national treatment is an important indicator that reflects the level of WTO member education service commitment.There are few commitments from WTO members to education services,and there is a wide gap in the level of commitments made by the countries that make commitments.There are some problems in the regulation of education services trade in the General Agreement on Trade in Services,and negotiations on multilateral service trade under the WTO system.The slow progress is a major challenge for them.The fourth part analyzes China's three free trade agreements,the China-Australia Free Trade Agreement,the China-Korea Free Trade Agreement and the China-Singapore Free Trade Agreement.The important representatives of the free trade agreement are very representative of the education service trade.Their breakthroughs and developments in the education service trade are of great significance to the subsequent bilateral negotiations and the development of educational services.The fifth part discusses the development direction of China's legal system of education service trade.China's existing relevant laws are in perfect development,and the legal system still faces many problems.The improvement of the legal system of education service trade can be based on domestic legislation,WTO and bilateral free trade agreements,as soon as possible to improve domestic laws and regulations,participate in the formulation of multilateral rules,seek bilateral cooperation,and provide legal protection for the development of China's education service trade.
