Nowadays, food security is regarded as the most significant social issue to be concernedby the governments and consumers. Accompanied with the process of globalization of foodsafety, agricultural, food and industrial products are become diverse and alter rapidly. Theconsensus among the consumer has the unanimous idea about the food security issue. Afterthe "San Lu milk powder" incident, food safety has become a long-term focus of mediaattention. After the "Watered Pork" event and the "bird flu" events, food safety issues have ledto a heated controversy among people. In an unprecedented pace of China’s urbanization inthe past decades, it engenders a wide range of social problems. Transportation, Due to theacceleration of urbanization, the daily storage and marketing of the food are undertremendous pressure. Developing countries has raised their urbanization stride, and limitedresources, poor infrastructure are undoubtedly outbreak of food safety risks lies. Great effortsas the Chinese government made, it still attracts the attention of consumers. Whether thegovernment agencies can obtain business information in the first time, and promptly deal withissues such as toxic and hazardous food has became the focus of media attention. In the lightof the research concerning food safety regulatory legal system, we peculiarly concentrate onthe relationship between our food security, especially the level of agricultural products in theinternational market competitiveness. It is indispensable to recognize that our agriculturalproducts are often returned, detention, lifting of trade contracts and waiver of any breach ofthese events. All of these will have brought serious damage to China’s foreign trade, China’sfood industry and even affect the goodwill in the international arena. Frequent outbreaks offood safety is exerted by the US-led Western countries an excuse to set the green tradebarriers, in order to disrupt the normal behavior of Chinese food exports and implementretaliatory measures. In this paper, the case of food safety supervision specifies the problems,and also concludes with a corresponding improvement measures that can provide a favorablereference for China’s food safety supervision Legislation.In addition to the introduction and conclusion, following four parts comprise this paper. The first part focuses on the general problem of food safety regulation. Theoreticalanalysis in the respect of the characteristics of food safety and food safety regulators and thecharacteristics of the food safety regulatory analysis, which combine with the current situationof the domestic food safety regulation that leads to the theoretical basis of food safetyregulation. The author addressed the basis of economics, management science, and law-basedfood safety regulation.The second section discusses China’s food safety regulatory problem. The current foodsafety issues have been severe, which will push up food safety supervision into anotherclimax. The main aspects of the regulatory responsibilities of the various regulatory exposethe problem of uncertainty and a lack of coordination issues. Furthermore, after the mainregulatory implement used by the regulatory aspects, the author talk about the issue, includingregulatory measures of risk monitoring and assessment, information disclosure system and soon.The third part of foreign food safety regulatory system was regarding the search methodissue. It introduces the connection with China’s current situation and social conditions whichprevailing in the U.S. and EU food safety regulatory system to inspect, identify ourshortcomings, to seek useful references.The fourth part is the advice to improve China’s food safety regulatory system response.Content is divided into three areas: Firstly, food safety supervision and coordination problemsbetween each other, as well as the power sector misconduct, abuse of power and other issuesis discussed as the proposal to address the responsibilities of supervisor. Second, the methodto improve our food safety regulatory is to prevent the risk-based monitoring and evaluationsystem and information disclosure system. Third, improve food safety regulatory liabilityregime.
