The Construction Of Extended Collective License System In China

The advantage of collective licensing regime is that it can minimize the transaction cost of copyright market, making it easier for users to get license, to improve the efficiency of licensing. But this classic system can not help users to get license from the non-participate right-owners especially when there is mass use of their works. The Nordic countries create the extended collective license to solve this problem and it makes the system more efficient.The extended collective license insists on copyright exclusivity. As the development of traditional collective management system, it still takes the advantage of centralized license of collective management to protect the interests of non-members effectively and promote the spread of their works. Due to the slow process of copyright protection, our legislation is relatively backward. There are still many shortcomings of our copyright collective management system, it is unable to fully play its due role. Accordingly people may have misunderstanding, even resentment, on this system and then they are rel uctant to authorize the collect ive managementorganizations to manage their works．Therefore the legislators shall amendthe copyright law to rationalize the operation mechanism of copyrightcollective licensing regime，and adopt an extended licensing system duly soas to exert the advantage ofcollective copyright administation better．This paper takes the elaboration of legitimacy and necessity about theextended collective license as a starting point．Then accord ing to the actualsituation of China’S copyright protection and the particularRy of extendedcollective management system，following the thread of modifying theexising system of copyright collective management，this paper makes adetailed description of how to build an extended collective license systemin OUF country,aims to provide references for imptroving our copyright law,then promoting the effective o peration of copyright collect ive managementsystem and the development ofChina’S copyright market．...
