From the beginning of the20th century, along with economic development, the rise of the civil rights movement, children’s issues have been unprecedented attention, related research activities on children has also been very active. Since China promulgated the "Law on the Protection of Minors", Child protection legal system has been basically formed, right to exist, the right to education, the right to health and development of children are effectively protected, Child protection situation has also been greatly improved. However, in real life, there are still a lot of violent or non-violent means to harm the children. This allows us to clearly aware of child protection situation is still not optimistic. For nearly a year, media exposure of a large number of teachers in child abuse, especially the exposure of kindergarten child abuse cases in WenLing, Zhejiang Province. After the case, WenLing police can only be farfetched to "crime of creating trouble" to qualitatively, and finally Acquitted the teacher by cannot constitute a crime. It had to allow people to question the system of children protection is too fragile. Therefore it is particularly important how to design problems for teachers in child abuse prevention and intervention a reasonable mechanism.Confronted with the frequent cases where teacher’s abuse crime. Scholars all put their most attention to its atrocity happening in families, as well as their focus on the deficiencies in Chinese homeschooling. However, fewer scholars attach importance to the atrocity from other aspects that teachers treat children badly and even consider why and how they have been brought about. Even if some articles are concerned with it, they almost discuss in general whether it is necessary to set up a law on treating children badly in terms of criminal laws, as well as how the boundary between teachers’rights in corporal punishment and punishment should be judged. Based on the problems above, the thesis is aimed at ponder and find why the crime of treating children badly is brought about from the aspect of criminality. First, the thesis will look for the reasons from the societal environment we live in because people’s delinquencies come to be nurtured with them gradually integrating into society. And the societal environment decides the forms of delinquencies. Naturally, the influences of societal environment are put much emphasis on, especially the culture’s immersing effects, when the crime that teachers make is thought deeply. Showing respect for teachers and attaching importance to education have been a Chinese traditional virtue. And teachers have been always occupying a holy position and having absolute authority on students in China. But it provides a convenient door for teachers to treat children badly that the managing pattern is too simplex. Meantime, teachers’ behavior comes to lose their standard and discipline as the modern societal culture mingles and the Medias mislead. What’s more, schools overtake the most important responsibility for students’ safety. However, nowadays schools have still lots of problems that can’t be neglected, especially the educational notion, whose wrong orientation has caused serious and severe influences to teachers and students. At the same time, family influences can’t be also neglected in the process of teachers’ treating children badly, especially for the patriarchs being indulgent in teachers’ corporal punishment. Indulging teachers too much make it possible to aggravate the cases most to happen frequently.To solve the problem of teacher’s abuse crime, State and Government must bear the main responsibility for it. To establish a sound system of protection of abused children, the primary legislation to do is to modify and improve the protection of children and set up institutions and competent authorities.At the same time, schools have to fill loopholes in their management, change the educational philosophy, Improve disciplinary system. Still more family should take responsibility too, parents should strengthen communication with children, raise awareness of children. Only by integrating all resources, build homes, schools, government defense network, can effectively curb the worsening of the current phenomenon of teacher’s abuse crime.
