Everyone has the right to life, liberty and security. With the increasing degree of economic globalization, the scale of service trade including transnational labor service expands continuously, and has a increasing impact on the economies of many countries. As the growing number of overseas workers, problems about protecting their rights caused great concern of labor exporting countries including China. Overseas workers provide transnational service, in this way, the protection of their rights is closely related to labor exporting and host countries. And it needs various ways including international cooperation.The Philippines, an important labor-exporting country in the world, manages their labor exporting strictly. The Labor Code Of the Philippines and Migrant Workers and Overseas Filipinos Act of1995both play a very important role in protecting the rights of Filipino overseas workers. The protection features can be concluded into the following five points: completed legal protection, scientific management mechanism, specialized protection funds, kinds of legal assistances, wide international cooperation.Respecting and safeguarding human rights is a basic principle of the Constitution of China. Chinese government has always attached great importance to the protection of overseas workers’rights. Since China became a member of the WTO, the degree of the opening up is on a new level, and the situation of protecting overseas workers is more severe. Nowadays, there exist many problems. For example, the legal system is not complete, the management system is not scientific and the government service is not available.By other’s faults, wise men correct their own. China should learn from the Philippines in protecting overseas workers. Firstly, keep pace with the times by protecting overseas workers in terms of Labor Law and enacting the specific law. Secondly, strengthen the participation of the labor department and build a scientific management system. Thirdly, strengthen legal assistance for overseas workers to protect their rights. Fourthly, provide more kinds of overseas insurance services. Last, pay more attention to the cooperation with international organizations and the destination countries.
