The Study On The System Of Post-legislative Assessment

From a generalized point of view, the post-legislative assessment is an indispensable part of the legislative process o It is to promote improvement of the quality of legislation through assessing the effect of legislation implementation. In recent years, many regions carried out activities of post-legislative assessment. However academic research on the subject is still in its infancy, most research focus on the definition of the concept of post-legislative assessment, the practical significances, the assessment methods and other issues, and there is less study on post-legislation assessment system construction. Therefore, it is necessary to research on the building of the system.This paper elaborates the basic theory of the post-legislative assessment, investigates the practice of this system in our country and foreign institutional situation. It focuses on the scientific building of the system in our country. In addition to the introduction, this paper is divided into the following four parts.The first part describes the basic theory of the post-legislative assessment. After analysis of the theory and legal provisions concerning the post-legislative assessment, it sums up the concept and characteristics of post-legislative assessment. Then it analyzes the relationship between the concept of post-legislative assessment and legal changes, enforcement inspection, and discusses the theoretical basis and significance of the post-legislative assessment.The second part reviews the evolution and characteristics of post-legislative assessment system abroad. Based on the introducing development of the Japan, the United States, the United Kingdom legislation assessment system, analysis of their characteristics, it sums up what China may learn from foreign laws.The third part researches the problem of post-legislative assessment in our country. After introducing the development of China’s system of post-legislation evaluation, according to the different evaluation object extraction of5samples. It analyzes the problems of post-legislative assessment to provide an empirical basis for the construction of this system.The forth part tries to build the scientific system of post-legislative assessment in our country,"ocusing on the analysis of the content of the assessment principles, subjects and procedures, it nakes recommendation about this system into "legislative law".
