Research On Post-legislation Assessment Of Intra-Party Regulations In China

In recent years,with the full implementation of the rule of law and the strict administration of the party,the status of the rule of law within the party has gradually increased,juxtaposed with the rule of law and the rule of law in society.But in the research field of the rule of law within the party,It needs to be improved that the evaluation of the rules of the party,especially post-legislation assessment of intra-party regulations.This article takes the post-legislation evaluation system within the party as the entry point,and examines post-legislation assessment of intra-party regulations from the perspective of jurisprudence.Establish a theoretical system that includes the main body of evaluation,objects,standards,procedures,methods,and other supporting measures for post-legislation assessment of intra-party regulations.Based on this,this article applies the principle of legislative evaluation to theevaluation of the post-legislation evaluation system within the party,from general theory to practical exploration,divided into four parts to explain the construction of the post-legislation evaluation system within the party in China.In the introduction,firstly,I summed up the theoretical research status of theinternal legal system and the post-legislation assessment of intra-party regulations in China,and introduces the definition and system structure of the post-legislation assessment of intra-party regulations.I sort out the research results and practical experience of post-legislative evaluation at home and abroad,and provides a template for the construction of post-regulatory evaluation theory within the party.Finally,combining with the background of comprehensively governing the country according to law and comprehensively administering the party strictly,it briefly discusses the significance of the research on the post-regulatory evaluation system within the party.The first chapter is the basic theory of the post-legislation evaluation system withinthe party.This part will separately explain the concept and characteristics of the post-regulation evaluation within the party,and comprehensively analyze the basic theory of the post-party evaluation system.First,compare the post-legislation evaluation system within the party with the post-legislative assessment,introduce the principle of national legal assessment,propose the concept of post-legislation evaluation system within the party,elaborate the connotation and basic theoretical framework of the concept.And explain the connotation and basic theoretical structure of this concept.Then,I regard the party’s internal regulations as a special legal norm,the theory and viewpoints of the usage theory are explained in the party’s internal laws and regulations,and several concepts of the party’s internal law review,filing,implementation,and supervision are compared,and the differences and connections are analyzed.Finally,it summarizes several prominent features of the post-legislation evaluation system within the party,and provides theoretical guidance for the next step to explore the value orientation and mode selection of the system of the post-legislation evaluation system within the party in China.The second chapter is the elements of the post-legislation evaluation system within the party.Taking the post-legislation evaluation of the party as an independent system in the rule of law within the party.Drawing on the relevant research results of post-legislative evaluation,especially the post-legislative evaluation of administrative law.Theoretically,the main body,object,standard,procedure,method and other elements of the post-legislation evaluation system within the party.While discussing the elements of evaluation after the party’s internal regulations,it should be compared with the second part of this paper.From another perspective,the diversity of the evaluation subject,the multiple choice of the evaluation model,the pertinence of the evaluation content and the feedback of the evaluation results are explained.In terms of the evaluation subject,select two major criteria to divide the assessment subject.One is to assess the relationship between the subject and the party organization,and the other is to assess the binding force of the assessment made by the subject.The connotation and extension of the internal evaluation subject and the external evaluation subject are separately stated,as well as the scope of the statutory evaluation subject and the non-statutory evaluation subject.In terms of the evaluation object,I am striving to summarize the content of the post-legislation evaluation system within the party as much as possible,and sort out the object of post-legislation assessment of intra-party regulations in the order of emergency to non-emergency.As far as the evaluation criteria are concerned,I have summarized six criteria,namely,political,legal,rational,coordinated,operational and economic efficiency.For the discussion of the evaluation procedure,the author refers to the post-legislative evaluation process and summarizes the process of post-legislation assessment of intra-party regulations into three stages:initiation,implementation,result presentation and feedback of assessment result.In terms of the selection of evaluation methods,the author refers to several typical sociological research methods,highlighting the objective and scientific evaluation of post-legislation assessment of Intra-party regulations.The third chapter is the construction of the post-legislation evaluation system within the party.First,analyze the necessity and feasibility of constructing a post-legislation evaluation system within the party.According to the research status and problems of post-legislation assessment of intra-party regulations in China,from theoretical research to practical exploration.Secondly,analyze the principles of the establishment of the post-legislation evaluation system within the party,and we will guide the concrete construction of the post-legislation evaluation system within the party in China with the principles of legitimacy,democracy,science,system and application.The fourth chapter is the feasible evaluation factors.The author seeks the status of post-legislation evaluation system within the party in China with the four main elements of subject selection,evaluation index system,evaluation procedure and evaluation methods.And put the feedback mechanism of the evaluation results as an important part of the post-legislation evaluation system within the party.The writing context of this paper is:the basic theory of the
