The Offence of Major Accident is ruled in article134of the criminal law.Generally speaking, the loss of a ship will more than the loss of a car, accidents happened in ship production operation always have some special situations, such as missing persons, based on this, I think it is necessary to research the application of the Offence of Major Accident in waterway environment.Firstly, I will introduce the fundamental theory of the Offence of Major Accident, master this is the precondition to grasp the offence, then I will discuss the type of accidents happened in waterway and when it happens how the judiciary dealt with it, next, I will analyze that the distinguish between the offence and other similar offence in order to exactly grasp its application in maritime, at last, I will deeply research the dilemma in practice and propose my suggestions about this.To learn the application of the offence will benefit for saving the judicial resources and improve the enforcement effectiveness.
