The Comparative Study On Ship Registration

As to the heart of the ship management, the ship registration system has deep impact on confirming ships'nationality and property rights. Therefore, the study of the ship registration system can be from two respects, the ship nationality registration and the ship real-rights registration.According to the laws of all countries, the ship must hang the flag of the country where it is registered. And the country has the jurisdiction over the ship, based on the ship nationality registration. To attract more and more ships registered, many more countries provide preferential policies for overseas ship-owners. We call these countries open registration countries. Other countries, just like China, use strict ship registration system which is different from the practice of open registration countries. Though all of these practices have their pros and cons, to china, strict ship registration system is not conducive to saving operating costs to Chinese ship owners. More and more ship owners choose to register their ships in the open registration convenient flag countries. This makes bad results on China's economy and shipping system. So, how to attract Chinese ships back to register in China becomes a problem. Some scholars have suggested that the second ship registration system should be set up in china. So, the study of it has practical significance.Compared with the laws and regulations relating to the ship real-rights registration in foreign countries, the ship real-rights registration system in China remains to be improved in future. The Real Right Law of the People's Republic of China is promulgated for effect. Some new system, just like"Registration of Advance Notice", has been established. The new systems have a positive impact on legislative reforms of ship real-rights law.This paper would like to analyze the present registration system in China through the research on the theory and the development of the ship registration in the world and relevant international practice. The writer also talks about influence the real right law of people's republic of China will bring on the ship registration system in China and legislation, inspiration from the law, and tries to give some advices.
