Study On The Evolution Of People’s Procuratoratejudicial Police Functions Since The Founding Of New China

The People’s Procuratorate judicial police, as an independent category within police force, has a system of responsibilities that involves nearly every aspect of procuratorial work, and the main task of whose is to maintain the functions of prosecutor in order by exercising police powers to prevent, to deter various illegal and criminal acts hampering prosecution activities. Judicial police is becoming more and more important, accompanying with the strengthening of procuratorial functions.Judicial police’s responsibilities has developed from unclear to nine items of today. It seems that judicial police function’s widening, but the effect in practice is not quite satisfied. Under-utilization of judicial police power is not only a waste of Judicial resource but also against to the intention of law making. After having studied, the writer found that the main cause is due to the unclear and irrational rules, which in great need to improve. Only in this way, can the judicial police meet the requirements of the new situation and new task.This paper, based on the Inner Mongolian procuratorial organs, analyzed the judicial police functional characters, effects and the current situation by making a pectination to the development of the judicial police function of the People’s Procuratorate, and proposed the target and principles to improve and to perfect the judicial police’s responsibilities. In this paper, the writer also made recommendations to improve and perfect judicial police function on the ground of practice in some Procuratorate in our nation.
