Building of the social safety nets in the country is an important issue to enter theadvanced countries. The progress of a country has been shown not only in economicstandard, but also in the degree of perfection of the social security system. Economicdevelopment, economic domination and the social welfare for the entire personalhave been close relationship, this matter is the hot topic among people.In this paper, by comparing the Social Security System in South Korea andChina, pointed out that the presence of the Chinese Social Security and legalprotection related to the senior citizens and aims to analyze the deficiencies of theselegal issues and may present improvement direction. I hope that this comparison canhelp China’s elderly social security and social management mechanism to improve.This article is written by comparison to between the Korean elderly System and theSocial Security Act and the welfare system of the elderly Chinese social security.Therefore, this paper studied “pension part of Social Insurance Law” and “Socialinsurance law for the aged” in China. South Korea’s elderly Social Security Act isdivided into "National Health Insurance Law,""National Pension Law,""Elderlylong-term care insurance law" and "Elderly welfare law". The "pension insurance andmedical insurance," in Social Insurance Law in China and South Korea’s "NationalPension Act and the National Health Insurance Law" can be compared. Moreover,"Elderly Protection Act" in China and "Elderly Welfare Act" in South Korea can bealso compared.In the first paragraph, I studied the meaning and feature of social security.Furthermore, I explain how to express the social security of senior citizens inConstitution in China and KoreaIn the second paragraph, for the welfare of the elderly, the Social Security Act inKorea basically can be divided into "National Health Insurance Law,""NationalPension Law,""Elderly long-term care insurance law" and "Elderly welfare law." Onthe other hand, China’s social security law basically can be divided into "Socialinsurance","Elderly Protection Act." The third paragraph focuses on the comparison and analysis of the socialsecurity laws being implemented in China and Korea. Because South Korea is facedwith aging population in1970, the introduction of the statues and system concerningelderly people is earlier than China. Through comparative analysis, this research cansupport more stable social security system and law related to elderly in China.
