Liability Study To Postal Loss Not Insured

Postal enterprises as the foundation of social life in a profession,assumes significant historical responsibility in modern life.Current,high efficiency,fast technology has become the subject of people’s lives,and therefore, postal enterprises to provide quick and relatively low cost of postal services will become an important needs of people choose to have mail.With the continuous development mailing services, postal enterprises not only provide consumers with a convenient, establish a good image of themselves,but also provides a fast, affordable consumer environment, or even stimulating the social and economic development speed.But,inevitably,because in real life some of the postal companies do not regulate the operation of the legal system and the relevant provisions are not in place,resulting in the message is not insured for the loss,according to a large number of disputes arise and difficult a reasonable solution.Currently,in practice, to resolve such disputes on the major challenges facing are: Qualitative liability is not clear; apply the principle of compensation is unreasonable; rules applicable law is not clear; explain the terms of the non-standard format. In this paper, a comprehensive and comparative analysis methods, mainly through the statement of the relevant provisions of the existing legal system, a comparative analysis of which there is a contradiction, a comprehensive analysis of each other’s unreasonable then put forward specific proposals, in order to structure the majority of these issues through four one analysis. The fifth part analyzes the mere use of the legal system to resolve such disputes drawbacks, and then propose a complementary regulatory regimes in other areas, hoping to improve the entire message is not insured for the loss, according to the solution of disputes, to build a more complete system of compensation.
