Study On The Legal Problems Of Intellectual Property Investment

As today’s knowledge-based economy is so prosperity, intellectual property has becomethe core of wealth creation for all industry resources. Intellectual property investment is aspecial form of investment which converted intellectual property into industrial capital.However, the intangibility of intellectual property rights make it more complex than tangibleproperty to invest, and will produce some problems in the investment，such as intellectualproperty subject disqualification, object disqualification and improper valuation. So we needto have scientific analysis and judgment for intellectual property investment, to avoid possibledamage of interest in the funding process, and to prevent risks which may occur in practice.This paper used comparative research, comprehensive analysis, summary of experienceand other methods for the study of intellectual property investment. Except the introductionand conclusion, the text is divided into four parts: The first part is the analysis of thetheoretical contribution of intellectual property investment. This part analyzed the meaning,features, feasibility of intellectual property investment, which is the theoretical basis andstructural basis of the full text. The second part is the legal issues in intellectual propertyinvestment. This part divided into three situations to discuss， which were subjectdisqualification, object disqualification and improper valuation. The third part is relatedlegislation of Chinese and foreign intellectual property investment. The fourth part is thesuggestions to solve the problems of intellectual property investment in China. This section isthe core content of the article. Through the analysis of the first three parts, this part putforward some suggestions to solve the problems from the subject and object of intellectualproperty investment, value assessment system, the legal system and so on.
