Private lending has centuries-old history in China, it is a traditional financing methods.With the development of the Chinese economy, private lending has been the financingchannels for SMEs in general, total social wealth is increasing in China, the per capitadisposable income, more and more, residents of financial prudence continues to mature, asa way of investment lending, private lending market to take shape, which played an activerole in promoting economic development. But China currently lacks a national specializedlegal regulation of private lending, lending cannot be formalized development, so therehave been many negative problems. Legal regulation of private lending, approach andavoidance, to play its positive role and avoid its negative effects, are at the core of thispaper. This article is divided into four chapters:Chapter I is overview of private lending. The first section defines the legal concept;the second section analyses the legal characteristics of the lending; the third sectiondescribes the development history and present situation of private lending; fourth analyzesthe lending section of the positive and negative effects.Chapter II is lending legal norms in China and inadequate. The first section status oflending laws in China, introduced private lending in different laws and regulations in therelevant provisions; the second section analyzes the lack of lending legal norms.Chapter III useful experience of foreign countries and regions. The first sectiondescribes the United States, Japan, India, Hong Kong and Taiwan regions private lending;Analysis of the summary in the second section, draw useful experience.Chapter IV perfecting the civil legal regulation of borrowing proposals. The firstsection proposed to set up a special private lending laws and regulations; proposed theestablishment of private lending market access and withdrawal mechanism in the secondsection; the third section raised the issue of perfecting the supervision system of privatelending.
