Legal Research On The Transfer Of The Using Right Of The Housing Land

Along with our country city with the rapid urbanization and urban area expanding, land is increasingly becoming scarce resources. Rural land question is at the heart of rural issues. The development of agriculture, the rural stability and safeguarding farmers’ rights and interests, and other issues are all expansion around rural land. The using right of housing land is an important land rights of farmers. Theoretical study and institutional analysis system for the transfer of the using right of the housing land has the extremely important theory significance and practical value. In this paper, the transfer of the using right of the housing land is as the research content.The first part analyzes the changes and problems in China’s current system of land using right. After the founding of New China, our country has established a farmer’s private ownership of land. With the development of history, our country has established collective ownership of land. This system are still been used till today.It has generated a lot of problems, such as the house build over the vacant phenomenon is serious; the right to use homestead is single. It is necessary to reform the rural residential the using right of the housing land. The second part selects three examples, introduces the main practices three places in the transfer of the using right of the housing land, and then makes a brief comment. The third part mainly discussed how to make the transfer of the using right of the housing land more legitimate, more reasonable operation. Discussed the basic principle, the premise of the transfer of the using right of the housing land, supporting system and benefit distribution.The transfer of the using right of the housing land problem of this study is still insufficient.I hope other scholars continue to improve it.
