Study On The Transfer System Of The Right To Use Rural Housing Land

The transfer of the right to use rural housing land is an important part of the right to use rural housing land, which is fundamental right concerning Chinese peasants'vital interests. In the rural practice, a considerable number of disputes and conflicts are concerned with the transfer of the right to use rural housing land. There are no specific rules about the transfer of the right to use rural housing land in the Property Law of the People's Republic of China passed in the fifth session of the tenth National People's Congress on March 16, 2007. Therefore, it is of great theoretical and practical significance to make an intensive study on the right to use rural housing land, to have effective regulation of its transfer by law, to rationalize the distribution of rights and lead to healthy development of the right to use rural housing land. This essay is comprehensive analysis, survey and study of the necessity of the legislation of the transfer of the right to use rural housing land, its value selection, its guiding method and some problems of establishing the legal system of the transfer of the right to use rural housing land. Based on these points, the author raises some ideas for the legislation of the right to use housing land in China.
