Our Country Cybercrime Preention And Control Research

With the rapid development of computer technology, computer network has become an important part of the world’s development, playing an increasingly significant role in every country’s’politics, military, economy and culture etc., however, the cybercrime has bred and spread. In order to guarantee the healthy development of the computer network and maintain harmony and stability of the network society in our country, this paper probes into the generation, the development trends and characteristics of cybercrime, and attempts to put forward several constructive suggestions to the prevention and control of cybercrime in our country from the perspective of the public security organs.The paper firstly analyzes the present situation, existing problems and forming reasons of the cybercrime in our country. Then, by researching the advanced experience of prevention and control to cybercrime in the developed countries, it studies the prevention and control measures to cybercrime from the aspects of the legislation, the justice and the society. Combining with the author’s working practice and using a large number of empirical analyses, this paper analyzes the prevention and control problems to the cybercrime in our country, especially in the public security organs and puts forward our own solutions on this basis.Legislation, to promote the adoption of legislation to improve judicial practice, but step by step, from the perfect start with administrative regulations and judicial interpretations, as soon as possible and strive to separate legislation to regulate cybercrime; judiciary to increase investment to purchase high-tech equipment, streamline assessment and working mechanism, the establishment of a strong network of police forces; multi-pronged approach to the social aspects of management and control, the whole society co-management of virtual community comprehensive management control system.The innovation of this paper mainly includes:(1) by plenty analyses from theories and cases in the legislative prevention and control, judicial prevention and control, and social prevention and control, it proposes new assumptions on the prevention and control to cybercrime;(2) on the basis of the previous research on cybercrime, it puts forward solutions on how to cope with the increasingly rampant cybercrime mainly from the perspective of the public security organs.
