Discussion On The Cybercrime And It's Prevention

As the accelerated development of high technology such as network technology, communication technology and so on, network application has gradually covered the people's learning, work and all aspects of life. Meanwhile, the cybercrime is also blustery along with the high technology. Its criminality and the crime type were more complicated day by day. It has brought tremendous negative influence to people's life. There are some difficulties in researching on cybercrime, because it requires a multi-disciplinary and multi-angle approach. The history of our country's cybercrime has been 25 years, many seniors of academic world have gradually penetrated to cybercrime's research. But so far, the concept of cybercrime has not been unified in the academic wrold. The author based on the existing scholarly research, put forward her understanding of the concept of cybercrime. And analyze the causes of cybercrime, the characteristics of cybercrime, the type of cybercrime and the behavior of cybercrime from the perspective of criminology. The author also analyzes the causes of why we have difficulties to deal with the cybercrime. and then proposes several countermeasures of cybercrime's prevention.The full text is divided to be the following three parts, besides the introduction and the conclusion.The first part, outline of cybercrime. This part first obtains from the network concept, introduced the concept of the network and the network's role in crime. Next to draw out the implication of cybercrime. Firstly, carry on the concept of cybercrime's forming process and summarize existing theory of cybercrime concept of our country. And then puts forward the author's understanding of the cybercrime. Secondly, the author analyzes the reasons which produce to the cybercrime, including the technical reason, the economic reason, the legal reason, the psychological reason and the cultural reason. Finally, the author analyzes the characteristics of cybercrime, including the nature characteristics of cybercrime, the characteristics of cybercrime's actor, the characteristics of the interests of law which cybercrime violated and the intelligent and technical characteristics of cybercrime.The second part, classification of cybercrime and main manifestations of our country's cybercrime behavior. In this part, the author attempts to conduct the classified research of the cybercrime from the multiple perspectives, including carries on classified according to the cybercrime's concept, to the compatibility between the cybercrime and the traditional crime, to the characteristic of cybercrime's actor, to the motive of cybercrime's actor, to the interests of law which cybercrime violated, to the characteristics of the victim of cybercrime. And then the author summarizes the quite prominent manifestations of cybercrime at present of our country, including the criminality of network pornography, the criminality of network cheating, the criminality of network gambling, the criminality of network infringing intellectual property, the criminality of network money laundering, the criminality of destruction network normal operation and the use as well as the criminality of harming the network information security. The author hopes that can deep the cybercrime's understanding and have the profit to academic.The third part, prevention countermeasures of cybercrime. In this part, first to analyze the causes of why we have difficulties to deal with the cybercrime, including the technical reason, the legal reason, the management reason and the consciousness reason. Next, the author proposes several countermeasures of cybercrime's prevention, including perfecting correlative legislation, increasing technical inputs, strengthen the network civilization construction, improving the public security organ's ability of internet supervision, strengthen the internal management and strengthen the international cooperation.
