With the rapid development of China economy,"rural tourism" as a new rural recreation industry, more and more people who from urban or rural enjoy it. Rural tourism also has become one of the important emerging strategic industries which can promote agricultural efficiency and rural incomes, rural development. In this thesis, combining normative analysis and empirical research methods, based on the new research based on the current operational types of tourist industries of "rural tourism" in nature and all kinds of chaos positioned facing the healthy and orderly development of the increasingly prominent status quo. From a legal perspective, around the "rural tourism" developing legal problems, the development of Zhejiang Province as a typical, theoretical and empirical research were done. There are four parts in the paper.Part one:It was about the law of "rural tourism" market access thinking. Focuses on the legal conditions of the rural tourism in this emerging tourism development may market access, organization, legal status, physical condition and procedural requirements.Part two:It was about the "rural tourism" tax burden analysis. Analyze the "rural tourism" taxable property, tax type and tax relief, according to the development of the strategic objectives rural tourism positioning stage of development and the role they played, proposed a particularly support of tax policy to develop "rural tourism".Part three:It was about "rural tourism" entanglement and consumer protection. Analyze the categories, causes and solutions of the current "rural tourism" entanglement, and consumer rights protection path.Part four:It was about "rural tourism" thinking and legislative proposals. The focus on the study of the guiding ideology and basic principles of legislation, with the system designed for key areas proposed to deepen the relevant legal construction, part of the system design ideas, strategies and policy recommendations.
