we attempt to make the research of the influences of empathy between criminals with different positions and victims on the criminal punishment force.The research using experimental method, randomly designed (three factors) to investigate the effect of empathy, position, and status on punishment justice. We select240subjects from Hunan Normal university.they are divid ioto eight group to assessment different matericals that consist of12cases.The results of this study show that:Status is significantF=123.96, p=0.000), there is significant interaction effect between status and empathy (F=178.152, p=.000), and there is significant interaction effect between status and position (F=4.184,p=.0043), there is significant interaction effect between the empathy and position as well (F=21.297, p=.000), which shows that the empathy, position, and status have influences on the fair punishment appraisal in two-way interactions.The spectators with high empathy to the victims think that punishment of criminals is very less,so they think must punishment greater for criminal; while spectators with high empathy to the criminals assume that the punishment of criminals is greater,so they think must punishment less for criminal. Low empathy to the in-group compare to low empathy to the out-group,the spectators think that punishment of criminals is very greater,they think must punishment less for criminal;high empathy to the in-group compare to high empathy to the out-group,the spectators think that punishment of criminals is very less,they think must punishment greater for criminal.Prompt:when the spectators have different status, position, and empathy, they have different judgments on the punishment to the criminals, which indicates that when we are analyzing the case, we should see them objectively rather than subjectively be influenced by the status and experiences of the criminals or victims.
