Now worldwide, more and more governments take corporate social responsibility as part of its sustainable development and national competitiveness.《the Decision on Major Issues Concerning Comprehensively Deepening Reforms》, clearly pointed out:that to improve the efficiency of enterprises, enhance the vitality of enterprises, to undertake the social responsibility as the focus, to further deepen the reform of state-owned enterprises. But there are considerable distance between the status quo of China’s corporate social responsibility and the public requires. Corporate social responsibility is not only the enterprise initiative behavior, also need legal to force. How to rely on the legal force to strengthen corporate social responsibility has become a problem worth researching.This paper combines corporate social responsibility with our historical traditions and the basic national conditions, analyzes the theoretical basis, in order to reveal the subject of this article: the research of the way enforcing corporate social responsibility by law. This paper is divided into four parts.The first part is an overview of corporate social responsibility. First, it introduces the theory of corporate social responsibility and its historical development, paves the way for the concept and the essential characteristics of corporate social responsibility as a following part. Secondly, it introduces the different concept that domestic and foreign scholars proposed, and defines a few confusing concept. Finally, it draws a conclusion on the concept, the classification and the essential characteristics of corporate social responsibility.The second part is the study of the theory about corporate social responsibility. As corporate social responsibility is introduced from the Western developed countries, so how to effectively integrate into our local resources, combined with China’s basic national conditions, be suitable for China’s corporate social responsibility system will be very important. Therefore, the second part is about the jurisprudence analysis of the local resources for corporate social responsibility. First it introduces the theory of corporate social responsibility which proposed by the foreign academic, then combines with the historical tradition and current situation of China to analyze the development of corporate social responsibility in Chinese local resources, trying to find the corporate social responsibility with Chinese characteristics. In the third part, the analysis of current situation and case. Through the collection of the information of corporate social responsibility from the social responsibility report, the sustainability report, the financial reports, the official website and other channels, the paper analyzes the implementation of the social responsibility of the China National Petroleum Corporation.In the fourth part, the author infers the construction of the law, and goes further to explore the practical issues of corporate social responsibility. It introduces the foreign rule of law, then analyzes the practice situation of legislation in China, points out our current problems and puts forward a sound proposal.The paper studies corporate social responsibility and the improvement of relevant systems in the view of law, economics, and management. Using comparative methods, from the foreign-developed theory of corporate social responsibility to the local resources, the paper research of the way enforcing corporate social responsibility by law, basic national conditions, puts forward constructive suggestions on the establishing and practicing mechanism of the corporate social responsibility in China.
