Research On The Laurence’s Theory Of Copyright

With the development of the digital age, the dissemination of information become more easily, many countries have strengthened the protection of copyright, which has restricted the development of culture communication and free culture. Laurence copyright theory put forward different views, think that should strengthen the protection of public interests, pay attention to the dissemination of information on the contribution of cultural innovation. This paper is divided into four parts, to introduce and analyze the Laurence’s point of view.The first part introduces the main content of Laurence,including the person and work"free culture", puts forward the basic view point of the Laurence. Lawrence Lessig, Stanford University Law School Professor, is the founder of the Stanford Center for Internet and society, the world’s most prestigious network of legal experts. Lawrence view brief summary is to be increased on the protection of the public interest, relax restrictions on copyrightThe second part is the new perspective on Laurence theory of copyright.copyright protection and strengthening the public interest is the main aspects of this part. Laurence elaborate his view on copyright protection from three aspects, the period, the scope of copyright protection, the scope of fair use.In addition,Laurence think we should strengthen the protection of public interests,recognize the piracy and network sharing should build a relatively relaxed legal environment.The third part is to analyze the viewpoint of Laurence. I agree with views of the renewal system, the fair use system,deductive works right, network sharing, and put forward my idea on the f the scope of copyright protection and legal protection.The fourth part is to give some advise on the China’s copyright protection according to the theory of the Laurence. Main problems existing in China is caused by copyright owner automatically gets copyright owner is unknown, in network environment of inaccuracies, the concept of reproduction rights for public protection is not in place, and so on. Combined with Lawrence’s ideas and personal understanding, should restore registration renewal system across the country, to redefine the right of reproduction, determined on the basis of the balance between copyright holders and the public interest a lenient laws to protect the environment.This thesis is through an analysis of Lawrence proposed a novel view of protecting the interests of right holders, advocate on the importance of public resources, and to promote legal reform.
