With the development of science and technology, the21st century which filled with network communication technology, biotechnology and other high-tech has challenged the traditional civil and commercial law that was formed in the old Mill Era. More and more consumers started to trade online as a result of the popularity of the computer technology. Internet consumption, as an important symbol of the era of Internet information and an essential component of Internet economy has also risen. The internet consumption provides us a new way to trade and it has offered the world an invisible and brand-new platform, outside traditional market. The consumers benefit from this too. On the one hand, Internet consumption is convenient, flexible and not restricted to time or plan; On the other hand, the consumers should pay attention to the process during which their rights may be infringed because of the features of internet consumption like new, open and high-tech demanding.This thesis will discuss problems existed when consumers want to protect their own rights during Internet consumption. The analysis on why they have those problems and the approporiate solution are included to seek the best way for Internet consumers to safeguard their legal rights.The first part of the thesis focuses on the different definition between the traditional consumer-related issues and the online consumer-related problems. Giving the concept and nature of the traditional consumption, discussing the laws and principles involved in the Internet consumption; the writer intended to state the importance of knowing the definition and feature of online consumers.The second part of thesis safeguarding online consumer’s legal rights is discussed. At first, the writer introduces the concept of safeguarding online consumer’s legal rights, which illustrates the fact that there are some special rights existed for online consumers besides the traditional consumers. Moreover, the people role of counterpart is mentioned. To be specific, counterpart is the person or institution who the online consumers can seek for help to when their legal rights are violated, usually the individual operators or the third-party network trading platform. In addition, consumers can also ask for research on the cot. Therefore, it is a very important step to know exactly who the counterpart is.The problem network consumers encountered when they try to fight for their legal rights are the main topics of the third part. The problems come from different aspects, the unfair standard terms, the difficulty to collect evidence, the hard choice of jurisdiction and the rights cost. Thus, the readers are going to be aware of the situation and hardship in this field through the specific and profound analysis on these problems.The last part of the thesis gives proposals about improving the law correspondly. For the unfair standard term problems, the writer suggests to resolve them from legislative side. In another word, more legal rights for the consumers and specific obligations for the operators. Besides, other issued should also be settled by justice. Online consumers could never be expected to protect their legal rights without proper and practical methods. However, this doesn’t mean the online consumers are law-free. The only way they can entirely enjoy their rights is to be rational, honest and conformed, which makes the online consumers and the operators trust each other and develops online consumption.
