The Research Of Several Legal Issues In Relation To Contract Of Crew Labor

Our country is also the largest maritime shipping superpower, shipping industry occupies an important position in China’s national economy. As the first-line workers of shipping,the crew are main labor who plays a vital role in shipping production. Compared to other industries on land, the crew at sea with liquidity, high technical requirements, the characteristics of occupational risks. Therefore, the crews labor rights needs special protection. Firstly, the concept and characteristics of the Contract of Crew Labor are analyzed, and the three elements of the labor contract legal relationship are elaborated highlighting the special characteristics of the Contract of Crew Labor compared with the normal Contract of Labor.These works provide a necessary basis for further study. Thereafter, from the domestic crew labor contract law and domestic industry according to the actual situation of the ship, this chapter selects several current hot issues of the Crew Labor Contract:the nature of the labor contract, industrial injury compensation, the burden of the cost of repatriation, crew assignment, etc, and the analysis and delibrations are focused on the issues in relation to the application of Labor Contract Law and the resovation of the labor dispute resolution. The last paragraph makes relevant suggestions for legislation to improve domestic labor contract crew, and provides theoretical guidance for law applicable and legislation of the employment contract of crew, promote the further perfect of our country’s crew labor contract law, maintain the rights and interests of crew.
