Our country is a shipping power. Shipping industry plays an important role in our economy. Meanwhile, in consideration of the public policy, the fact that seaman serving on ocean ships will affect the development of the shipping industry makes it meaningful to protect the interest of seaman. Moreover, crewmen, playing an important role in navy defense, are commonly regarded as one of reserve for navy power.However, deeply affected by the system of planned economy in China, provisions governing rights enjoyed and obligations borne by crewmen are scattered in pertaining laws and regulations. Crewmen's competency and masters' authority are stipulated in principle in the Maritime Code of PRC enacted in 1993. For a long time, Regulations on Administration of Seamen set out by COSCO is applicable as seaman law. Up till now, no special legislation in respect of seamen has been carried out to protect seamen's interest. As a result, practical needs cannot be satisfied by the present provisions governing seamen's rights and obligations. Due to the inherent danger in maritime adventure and present transference of Chinese society, profession as a seaman is not so appealing as before so that shipping industry has witness a rough decline in excellent senior seamen. Requirements for systematic training, good mental and physical qualities and long-term accumulation of experience make the profession as a seaman completely different from professions onshore. It is especially true of senior seamen.As result, a long-term plan and enactment and perfection of policies and laws and regulations are essential to maintain an excellent team of seamen. With the development of our economy, the current legal system of seaman law does not meet the requirement.Therefore, this dissertation will focus on the discussion of some aspects of seaman law, including the seaman labor contract, social security system and crew labor output. The legal system concerned should be improved so that our seamen'srights and interest can be effectively safeguarded and our seamen's comprehensive qualities can be enhanced, which may help gradually accomplish the goal of making the navigation safer and the ocean more beautiful.
