| This paper sets forth and analyzes several legal issues in relation to the Contract of Crew Labor. First, the concept and characteristics of the Contract of Crew Labor are analyzed, in particular, the subjects of the Contract of Crew Labor are analyzed highlighting the special characteristics of the Contract of Crew Labor compared with the normal Contract of Labor. These works provide a necessary basis for further study. In this chapter, the impacts brought by the promulgation and implementation of The Labor Contract Law onto the Contract of Crew Labor are also discussed. Thereafter, analysis and deliberations are focused on the issues in relation to the application of the Labor Contact Law to the Contract of Crew Labor, in particular, on the basis of comparison of the Contract of Crew Labor without a third part and the agreement for crew dispatch, a number of issues in relation to the application of the Labor Contract Law to the said two kinds of contracts are discussed in details, with a hope to provide assistance to the future revision of the third chapter on ship's crew of the Maritime Code.. In the last Chapter, bearing in mind the deficiencies existed in the application of the Labor Contract Law to the Contract of Crew Labor, specific proposals for revision of the Chapterâ…¢of the Maritime Code are put forward. |
