Study On The Legal Status Of Villagers’Committee In Rural Land Trust

Compared to other systems, trust is a better system to manage the property of others, it was firstly used in financial fields in china, with the rapid development of economy and urbanization, a large number of farmers were swarming into city, and engaging in second or three industry, resulting in a lot of land fallow in rural areas, this can affect the country’s food security, therefore, speeding up the transfer of rural land to be on the agenda, Some scholars were trying to use trust as a new land transfer mode, applied to the circulation of rural land, promoting the healthy development of rural land market. In our country, the township (town) government is the lowest level of administrative organs, and the villagers’ committee as a grass-roots mass and self-government organizations, connecting link between the government and farmers, is at the forefront of the national policy of communication and execution, shouldering the responsibility for coordinating the production and convenient it is familiar to the use of rural land, the development of rural situation and villagers living. How to play the role of the village committee in the rural land trust, it has important practical significance for the process of rural economy and social development and maintaining rural harmony and stability, the author tries to seek the legal status of villagers committee in the rural land trust, as a service and supervisor, let it further play the role in promoting land circulation. This article is divided into six parts:the first part briefly introduces the background, the research significance, the research status and methods and innovation; the second part mainly from the origin, concept and characteristics of trust, to compare the difference between trust and agency, brokerage, intermediary, gifts and other related systems, to obtain the advantages of the trust, analysis on the concept, land trust characteristics and patterns, defined the concept of rural land; the third part from the concept of legal relationship, to explore the relationship between the trust of rural land, rural land trust concept extraction, and research the necessity and feasibility of rural land trust; the fourth part starting from the historical evolution of the villagers committee, through analysis of related concepts, defined the nature of the villagers committee, discussion legitimacy of the villagers’committees in rural land trust, accurate localization of the rural land trust in the villagers committee position; the fifth part through the introduction of Shaxian County land trust model in Fujian province, further analyzes the status of the village committee in the rural land trust; the last part discusses to perfect village committee’s status from two aspects of legislation and judicial in rural land trust.
