The Investigation Report On The Protection Of Employees’ Occupation Health Rights In Huaibei

The newly revised "occupation disease prevention law" come into effect in December31,2011. The new law:workers shall enjoy the protection of the rights of occupation health. Legislation has made provisions for occupation health rights of laborers, but the effect was still need to be verified, especially when the occupation disease susceptible populations are in a weak position in the political, economic, social, right side.Enterprise staff working in full occupation hazard environment, create value for the enterprises and society, but whether their occupation health rights and interests effectively protected, whether the government take effective supervision and services, whether the enterprise have the implementation of supporting facilities and management, whether the employees is aware of their rights, whether rights of the channel is expedite, all these problems will be investigated in this paper.First of all, the author makes a description on the researching context, actuality and means of the paper.The first chapter, related concepts, for occupation health rights of workers, and the characteristics of the specific content is discussed.The second chapter, the basic situation of the survey sample statistics. Analysis of the current situation of occupation disease prevention and control work in Huaibei City, mainly introduces the status of implementation of Huaibei city safety production supervision department, occupation health service related laws, and for the enterprise occupation health protection were summarized.The third chapter, mainly sums up the problems of Huaibei city occupation health. On the basis of the investigation, found the following problems:the first is the regulatory issues, information is not shared between functional departments, with the lack of coordination; small and medium-sized enterprises have difficulties in supervision; the second is the health services, lack of relevant hospital diagnosis part project occupation disease qualification; the third are involved in the problems of democracy, employee occupation health right and the right to participate in not fully support; the forth is the social security problems, the work-related injury insurance fund itself in the occupation disease prevention and control work more negative, not fully play its preventive function, lack of social assistance occupation patient outside the coverage of industrial injury insurance.The fourth chapter, mainly puts forward some legal suggestions on occupation health work in Huaibei city. There are:1, a sound legal system, especially on the legal responsibility of the enterprise should bear;2, enhancing service ability of government and law enforcement;3, give full play to the supervisory role of the union, establish consultation mechanism of employees and enterprises;4, improve the occupation disease protection system.
