Model Selection And Construction Of The Victim Assistance System

The construction of the victim assistance system marks the level of one country’s civilization and reflects the economic and social development level of this country. Confirming and realizing the assistance is the main way to protect their rights. But because of the limitation of the litigation system, the victim is hard to realize their claims for compensation through the litigation procedure. So in recent years, facing these contradictions and conflicts, countries and regions conduct some legislative practices in accordance with their specific situations and accumulate some experience and advanced concepts in the process of actively practice. These positive exploration and practical activities play a large role in the construction of the victim assistance system which accords with our country’s conditions.Through the analysis and research on the basic theory of the victim assistance, the author explores one legislative mode which suits for our country by analysing our victim assistance pilot work and some oversea legislations. And then the author tries to standardize the principle, the scale, targets, conditions, sources of funding and so on.There are five chapters in this paper. The first chapter mainly discusses the related concepts of the victim assistance system and the value. The author defines the victim and expounds the concept and value of the victim assistance system. The second chapter introduces the basic theory of the victim assistance system. On the basis of introducing and explaining many theories of the victim assistance system, the author presents a proposal:"with the state responsibility as the theory as the main body, supplemented by the social insurance", which as our country’s theory evidence to establish this system. The third chapter analyses the present situations and existing problems in different places of our country in order to provide some valuable experience for the construction of China’s victim assistance system. The fourth chapter refers to the other legislations from some typical countries in Anglo-American law system and Continental law system. Through the study of the fourth chapter, the fifth chapter tries to find out the goods which can be learned from in the process of improving our legislation and tries to construct a victim assistance system which is reasonable and effective.
