Research On Students' Rights Relief Mechanism University Roll Management

The object of this study is to improve right relief mechanism during student enrollmentmanagement process, so that the school enrollment management could be implementedaccording to the law, the university students’ awareness of rights protection or obligationfulfilling could be enhanced. Humanistic Educational function could be given full play to createa harmonious campus environment.Supported by theoretical education, administrative law, student rights theory, this paper takeschool enrollment management as an entry point to discuss from both theory and practicethrough literature analysis, questionnaires, and case studies.Through case analysis on some university students in Taian, the underlying causes ofstudents-university disputes and students’ right relief insufficiency is found as follows: first,Lack of due procedure in school management, imbalance between punishment and education,weak legal awareness of managers, etc. Second, Lack of credibility in students’ thoughts andbehavior, indulgence in online games, weariness, poor awareness of their rights and obligations,etc. Third, non-standardized school complaints system with unsmooth complaint relief channel.For all above causes, focusing just on relief afterwards is not enough. Beforehand, duringprocess and afterwards should be taken into account to improve the students’ right reliefmechanism in enrollment management. System management, thinking and behavior education,and broaden relief channel should be combined together to explore a wider scope.Firstly, from innovating school management system and strengthening moral education onuniversity students to improve prior relief.(1) Credit system reform should be advanced through improving various elective types andthe proportion of elective courses. Students should enjoy more liberalization through flexibleelective ways, so that their interest in learning could be stimulated to a multi-level andmulti-angle way.(2) Specialty restrictions should be relaxed appropriately. The students could be allowed tochange their specialty more freely while social needs and personal interest are taken intoaccount. (3) Learning years should be relaxed appropriately. Some students in difficulty should behelped to complete their studies in phases to reduce possible drop-out due to external factors.(4) Warning system should be built to monitor student rewards and punishments in schooldynamically. The use of information technology in this warning system could be convenient notonly to help teachers guide their students in different levels, but also to enhance theircommunication with parents to help students complete studies successfully.(5) Tracking education should be implemented on students who violated the discipline.Examination law should be strengthened and credit education should be reinforced. Theuniversity students’ legal education should be increased to enhance their awareness of properobligation fulfilling and rights protection.Secondly, the procedure management should be completed to improve relief during process.The legal concept of managers should be strengthened by standardizing their behavior to strictlyfollow the principle of law and due process. The managers should follow proportionality andrealistic principles, and should judge on evidence and research, while accept appealing withoutpenalty. So the managers could implement the school administration according to the law.Thirdly, the appealing system should be improved and the relief channels should be smoothto improve relief afterwards.(1) Standardizing grievance procedures and hearing procedures(2) Appropriately expanding the acceptance range of complaint(3) Optimization on the organizational structure of the complaint Commission(4) Explicitly dealing with complaints committee on their discretion(5) Establishing a reasonable complaint with the administrative on reconsideration andadministrative litigation to make a smooth relief channel.The innovation of this paper is to form a comprehensive three-dimensional reliefmechanism of students’ rights which start from three aspects of beforehand, during process andafterwards while combined with system management, thinking and behavior education and legalremedies.With the constant improvement of the national legal system and university studentsconsciousness of rights protection, the university enrollment managers are required to explorehow to improve students relief mechanism. This is beneficial to promote the law awareness of managers and to make the management more standardized and legalized. Also, it is conducive torespect and protect the legitimate rights of university students, to strengthen and improve theideological and moral education of university students. In a word, it has great theoretical valueand practical significance to build a harmonious educational environment.
