Research On Problem About Realization Of University Students’ Rights

The speeding up of legal system of socialist, the development of the reformation of education system and growingly harmonious campus construction make the concern of Students’ Rights to a new height. The occurrence of emergencies and crises affects the harmony and stability of colleges and universities. However, the initiators of these events are students themselves, whose rights can not be realized,and those are the source of the occurrences.Therefore,the successful construction of harmonious campus is decided by the realization of students’ rights.The realization of Students’ Rights ought to be carried out because it conforms the trend of the time.In terms of jurisprudence, rights is closely related to the status and identity of its subjects. As a particular social group, students are collection of multiple social roles and relations. In this paper, the rights of students explored are along with students’ educated identity. The full realization of rights can boost college students’ self-identification, which would help stimulate their enthusiasm and creativity. The paper broadly includes the following components:It is an overview of Students’ Rights in the first part. Based on existing laws and regulations text,it presents students’ statutory rights, including substantive and procedural rights,then demonstrates the need for realization of rights, from the origin, the relationship of rights and obligations and so on.The second part relates to the current situation of College Students’ Rights. University Students’ Rights have made great progress and gradually established a legal system. The mode of higher education management has changed and the awareness has increased.However, it is undeniable that infringed phenomenon is uncommon and many rights are not realized.In the third part,the author analyzes the reasons which make the insufficient realization of students’ rights. The traditional culture, unsound legal system of higher education, misconduct management of the university, limitation of right awareness and conduct are included.The fourth part is an exploration of the way to achieve Students’ Rights. Culture shaping,a sound legal system,a new relationship between students and university would be reasonable to solve these problems.
