After a series of evolution, our maternity insurance system has gradually improved, the basic form of social co-ordination maternity insurance model has established, but now there are still many shortcomings:The main subject of maternity insurance is limited in the range of job workers who signed a labor contract, maternity insurance benefits is still in the low state, maternity insurance law is not one of the social security rights as citizens should have the right to be protected. The main reason for the existence of these shortcomings maternity insurance has the following aspects:First, the legislative purpose is imperfect. Second, the legislative level is low. Third, the premise of maternity insurance is the existence of labor relation. Fourth, the company has responsible for the payment of maternity insurance, workers do not pay maternity insurance. In addition, civic consciousness, government responsibilities missing, government supervision weak, punitive measures shortage is caused by the above reasons.For the above shortcomings, after the studing about the maternity insurance system for foreign, this paper describes three aspects of maternity insurance system improvement measures. The first is expanding the subject of the maternity insurance. Improve the legislative purpose and the legislative level, there will be premised on an employment relationship as the ultimate goal of the maternity insurance system reform, expanding the scope of our maternity insurance in accordance with China’s national conditions. Secondly, in the case of perfect maternity insurance system is not fully established, improving existing maternity insurance rights and improving the existing main maternity insurance benefits will become imperative. Mainly includes two aspects:improving male maternity insurance benefits, expanding the rights of the female relatives of male citizens enjoy their maternity insurance benefits; improving maternity insurance management system, establishing the conditions that enterprises and individuals pay maternity insurance together, improving maternity insurance fund management system. Third, to develop the maternity insurance system, we must improve all aspects of the legal responsibility of our government, including legislation responsibility, supervision responsibility, finance responsibility and other aspects of responsibility.
