On Perfection Of Legal System Of Maternity Insurance In China

Maternity insurance is an important part of the social insurance system, which can insure the economic compensation and the medical treatment of the women during the maternity period. The way of social pooling can disperse the risk of the cost of the maternity, which ultimate aim is to secure the equal employment rights between the men and the women. If this problem not be solved reasonably, the substantial legislation and the formal legislation can not remove the gender discrimination to realize the equality of men and women.Under this background, through the analysis of the current situation and the development of the maternity insurance, this paper discuss the perfect of the system of maternity insurance.This paper consists of three parts, except the preface and the conclusion.The first part analyzes the concept, category and aim of the maternity insurance.The second part reviews the history of the maternity insurance, analyzes the basic contents and legislation of the current maternity system. On account of the problem during the implement of the maternity insurance, this paper thoroughly analyzes the drawback of the institutional design, management, duty of the nation and person.The third part explores the reasonable ways of developing the maternity insurance by summarizing the inadequacy of the current system. This paper proposes that the general thought and the development direction of the current maternity insurance. After that, this paper demonstrates the scope, right and duty, supervision and administration, supporting measures of the maternity insurance. In the end, this paper takes the macroscopic aspect and the microcosmic aspect into the consideration by implementing the aforesaid ways to complete the maternity insurance under the market economy.
