The Problem Of Breach Of Contract In Job Search Among Fresh University Graduates

In recent years, with the scale of higher education continues to expand inChina, the employment of university graduates has increasingly become the focusof the community. Compared to the general job search groups, the job searchprocess of graduates has its own characteristics. Based on the proposed model ofthe fresh university graduates’ searching job from the point of job search behavior,this thesis investigates the role of the liquidated damages and puts forward theconstruct standards of signing jobs and the rules of the enterprise in constructingthe liquidated damages. The main contents are as follows:A job search model with single select of two-stage for college graduates isestablished. This thesis investigates the influence on signing jobs of liquidateddamages of fresh university graduates and puts forward the construct standardsof signing jobs and the rules of the enterprise in constructing the liquidateddamages. The results demonstrate that the students should judge whether thereturn from the job arrived is greater than the expected return when they arenot sign, if the result is yes he should sign the job, If not, he should judgefurther whether the liquidated damages of the job is greater than the maximumliquidated damages he can accept. Meanwhile, enterprises can set an optimalliquidated damage to maximize their expected utility based on the wage theyofer and the type of each student.A job search model with multiple select of two-stage for college graduates isestablished. This thesis includes two models, one is two choices in the first stage,another is several choices in the second models. This chapter analysis how shouldstudents choose when facing multiple jobs, whether to sign a job when there willbe several jobs in the future, and so on. Furthermore, the importance of thesocial cost of breach of contract for both students and enterprises is discussed.A model of continuous job search for college graduates is established. Thisthesis discusses the form of the students’ maximum acceptable liquidated dam-ages and the rules of the enterprise in constructing the liquidated damages based on a continuous work search process, and numerical examples are given to illus-trate the meaning.
