Dilemma And Countermeasures Of Food Safety Regulatory System

To grasp the theory and research status quo, the author have retrieved and studied many literatures in food security and food safety supervision. By analysis of the status quo of food safety supervision system in Guangdong Province, this article raises current problems in food safety supervision system in the respect of legal system of food safety and food safety inspection system in Guangdong Province. Based on these problems, deep analysis and corresponding reform suggestions to the food safety supervision system in Guangdong Province is given in this article. The literature search mentioned in this article includes the collection of domestic and foreign literatures. The author of this article found out the successful experience of foreign developed countries by comparing the current food safety supervision system in Guangdong Province and food safety system in foreign countries. The author of this article hopes the successful experience of foreign developed countries shall help on the improvement on the food safety supervision system and the improvement on the role of the food safety supervision system in Guangdong Province.Through survey and research, the author of this article found that the legal system of food safety in China mainly included special laws of food safety developed by the National People’s Congress and its Standing Committee administrative regulations of food safety formulated by the State Council, departmental rules and regulations of food safety introduced by departments of the State Council, and laws and regulations of food safety developed by the municipalities, provincial, autonomous region promulgated by the National People’s Congress and its Standing Committee.In the respect of the regulation system, the problem of Guangdong Province, include unreasonable setting and operation of supervision agencies food safety supervision measures are not in place, the inadequacy of legal and regulation system and inspection standard system of food safety. Based on the problems which are mentioned above, the deep analysis and reasons are given in the four aspects in the article. In the analysis of the food security sector responsibilities, the article mainly analyses the responsibility of the following sector:the Food Safety Commission of the State Council, the Ministry of Agriculture, General Administration of Quality Supervision, Inspection, the health sector, the business sector, the Ministry of Industry, the business sector, the Food and Drug Administration and the public security organs.In the aspect of cooperation of food safety system in China and foreign developed Countries, the status quo of food safety supervision systems of Europe, the United States and Japan are analyzed. Based on the actual situation of food safety in Guangdong Province, the article state the inspirations to Guangdong Province from advance experience of foreign developed countries in four aspects, which are responsibility system of food enterprises, system of preventive, system of risk analysis and system of entire supervision which run through the whole food chain. Based on the problems found and drawing the successful experience of foreign countries, this article raises a series of suggestions about the improvement of food safety supervision system of Guangdong Province.
